These Terms and Conditions of Sale (hereinafter referred to as the "Terms") govern exclusively the sale of products concluded remotely via the website accessible at barkingroadfurniture.com (hereinafter the "Site"), between Barking Road Furniture, whose registered office is at 317 Barking Road, London, E13 8EE, United Kingdom (hereinafter the "Seller"), and any individual or legal entity placing an order via the Site (hereinafter the "Buyer").

Any order placed on the Site implies the Buyer's unreserved acceptance of these Terms, which prevail over any other document. The Seller reserves the right to modify these Terms at any time; the applicable Terms are those in force on the day the Buyer places the order.

These Terms are intended to define the rights and obligations of the parties in the context of the online sale of products offered by the Seller on its Site, as well as the procedures for placing, confirming, paying for, delivering, and cancelling orders. They apply to all sales made on the Site, without exception or restriction.

Article 3 – Products Offered for Sale

The products offered for sale on the Site are described with precision in the corresponding product sheets, including their essential characteristics, dimensions, materials, prices, and any restrictions.

The Seller endeavours to guarantee the accuracy of the information and visuals presented on the Site. However, minor differences may appear between the actual product and its visual representation, particularly in terms of colourimetry. As natural materials, solid wood may exhibit variations in grain and colour, which are inherent characteristics and not defects.

Products are offered within the limits of available stock. In the event of a product being unavailable after order validation, the Seller will inform the Buyer by email as soon as possible and will proceed with the cancellation and full refund of the sums paid for the unavailable product, without additional charges.


Article 4 – Product Prices

All prices indicated on the Site are expressed in Pounds Sterling (£) , inclusive of UK VAT where applicable. Delivery costs are indicated separately before order validation and are added to the product price.

The Seller reserves the right to modify prices at any time without notice; the applicable price is that indicated on the Site at the time the Buyer places the order. Promotions, discounts, and special offers are valid within the limits of available stock and for the period indicated on the Site.


Article 5 – Placing an Order

The Buyer places an order on the Site by following these steps:

  1. Selection of desired products and adding them to the shopping basket;

  2. Verification of order details and possible modification of the basket;

  3. Completion of delivery and invoicing details;

  4. Express acceptance of these Terms;

  5. Validation and payment of the order.

After payment validation, the Seller sends the Buyer an order confirmation email, including all order details (products, prices, delivery costs, contact details). This email constitutes proof of the conclusion of the sales contract between the parties.

The Seller reserves the right to cancel any order that is suspicious, fraudulent, or does not comply with these Terms, particularly in the event of non-compliance with the sales conditions, without compensation.


Article 6 – Payment Methods

Payment for the order is made in full at the time of validation, exclusively by bank card via the secure payment platforms offered on the Site.

All payments are made via secure payment providers, in accordance with PCI-DSS standards and European banking regulations. The Buyer guarantees that they have the necessary rights to use the selected payment method. In the event of payment refusal by the bank, the order will be automatically cancelled.

Payment data is encrypted and is in no case retained or used by the Seller for commercial purposes, in accordance with UK GDPR. No other payment methods (PayPal, bank transfer, cheque, etc.) are accepted on the Site.


Article 7 – Delivery of Products

Products are delivered to the delivery address indicated by the Buyer when ordering, within the timeframe indicated on the product sheet and at the time of order validation. Delivery times are calculated from the date of order confirmation by the Seller.

Delivery Area: We currently deliver to addresses within mainland UK (excluding some remote islands and Northern Ireland, as indicated at checkout).

Order Processing Time: Orders are carefully prepared and dispatched within 1 to 2 business days (Monday to Friday, excluding UK public holidays).

  • Order Cut-off Time: Orders placed before 2:00 PM (London time) on a business day will be processed and dispatched the same day.

  • Orders placed after the cut-off time will be processed on the next business day.

Estimated Delivery Time:

  • Transit Time (after dispatch): 1 to 2 business days via our professional furniture courier service.

  • Total Estimated Delivery Time (from order placement to receipt): 2 to 4 business days.

Please note: These delivery times are estimates and may vary due to logistical factors beyond our control, such as weather conditions, strikes, holiday peaks, or courier delays.

Delivery Costs: Our standard UK delivery is free of charge. For premium delivery services (where applicable), costs will be clearly indicated at checkout.

The Buyer is required to inspect the condition of the package upon receipt. In the event of a damaged package, loss, or missing content, the Buyer must make a written reservation with the carrier within 48 hours of receipt and inform the Seller by email within the same period.


Article 8 – Right to Cancel and Returns

Under the UK Consumer Contracts Regulations, the Buyer has the right to cancel their order within 14 days of receiving the goods without giving any reason (for distance sales).

The cancellation period ends 14 days after the day the Buyer (or a person they nominate) receives the goods. The Buyer must notify the Seller of their decision to cancel within this 14-day period and then has a further 14 days to return the goods.

In addition to this statutory right, we offer a 14-day voluntary return period for eligible furniture purchases.

Conditions for Return:

  • The furniture must be unused and in the same condition as received.

  • It must be in its original packaging and in a resalable condition.

  • Not assembled — furniture that has been assembled cannot be returned unless faulty.

  • All accessories and instructions must be complete.

Return Costs:

  • For faulty, damaged, or incorrect items: The Seller covers the full cost of return transportation and issues a full refund.

  • For change of mind (non-fault) returns: The Buyer is responsible for the return transportation costs.

Refund Timeline: We aim to process refunds within 3 business days of receiving the returned goods. In all cases, we will process the refund within 14 days as required by UK law. Refunds will be made to the original payment method (VISA or Mastercard).

Article 9 – Legal Guarantees

The Seller is subject to the legal guarantees provided for by UK consumer law, in particular:

  • Consumer Rights Act 2015: Goods must be as described, fit for purpose, and of satisfactory quality. If goods do not meet these requirements, the Buyer has the right to a refund, replacement, repair, or price reduction.

  • Consumer Contracts Regulations 2013: Provides the right to cancel within 14 days of receiving the goods (as detailed in Article 8).

Nothing in these Terms limits or excludes the Buyer's statutory consumer rights. In the event of a non-conforming product, the Buyer may request a repair, replacement, price reduction, or full refund in accordance with applicable UK law.


Article 10 – Intellectual Property

All elements of the Site (texts, images, visuals, logos, graphics, databases) are the exclusive property of Barking Road Furniture or its partners and are protected by UK and international intellectual property law. Any reproduction, representation, modification, or total or partial exploitation of these elements is strictly prohibited without the Seller's prior written permission.


Article 11 – Data Protection

The Seller collects and processes the Buyer's personal data in accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

The data collected is used exclusively for order processing, product delivery, customer relationship management, and invoicing.

Article 12 – Liability

The Seller's liability is limited to direct and foreseeable damages resulting from the performance of this sales contract. The Seller cannot be held responsible for indirect damages (loss of profits, business interruption, etc.) related to the use of the products ordered.

The Seller is not responsible for failures resulting from the Buyer's fault, a case of force majeure, or any event beyond the Seller's control.


Article 13 – Disputes and Applicable Law

These Terms are governed by and construed in accordance with the laws of England and Wales.

In the event of a dispute relating to the interpretation or execution of these Terms, the parties will endeavour to resolve the dispute amicably. Failing this, the dispute will be submitted to the exclusive jurisdiction of the courts of England and Wales.


Article 14 – General Provisions

If one or more clauses of these Terms are declared null or unenforceable, they will be deemed unwritten without affecting the validity of the other clauses.

The fact that the Seller does not enforce one or more provisions of these Terms does not constitute a waiver of the right to enforce them later.
